EXPLANATION AND SUMMARY

On October 23, 2023, as a conclusion to the project Code Create Vienna, the Town Council approved updated Zoning and Subdivision regulations, which were adopted as a new Chapter 18 of the Town Code. The new code became effective on Jan. 1, 2024.

 

During the code update process, certain topics were identified as "pinned" items that, for various reasons, would need to be addressed after the updated Chapter 18 was adopted. The Town Council and staff also discussed that the zoning and subdivision ordinance is a dynamic document, subject to regular reviews and updates.

 

In January 2024, the Town Council set four priorities for calendar year 2024.  Among those priorities were follow-up amendments to the Zoning Ordinance. For that reason, staff met with the Town Council over several sessions from February through May 2024 to review the “pinned” items and receive guidance on them, including the priority of addressing the proposed edits.

 

On October 7, 2024, the Town Council reviewed a list that represented the Town Council’s identified highest priorities, but also some additional proposed changes that staff identified from the first nine months using the updated code. The proposed changes are separated into two tables - Proposed Corrections and Proposed Edits.

 

At the same time, staff is pursuing some of the longer-term policy questions identified by the Town Council (including lighting and parking), and will bring discussions of these items to future agendas.

 

A series of attachments support this agenda item. Attachment 1 provides the staff memorandum, which includes a guide to the other attachments. Attachments 2 and 3 provide a summary of the proposed changes. Attachments 4 through 15 show each proposed code amendment within the relevant code article. Attachment 16 provides the recommendation memorandum from the Planning Commission.

The Department of Planning and Zoning recommends holding the public hearing, reviewing comments from the public and the Planning Commission, and making decisions on each proposed amendment to Chapter 18.

Town Attorney Recommendation:  The Town Council may conduct a Public Hearing and consider the recommendations of the Planning Commission on the proposed edits and amendments to Chapter 18, in its discretion.

 

Town Manager Recommendation:  I recommend the Town Council approve  amendments to Chapter 18 of the Town Code as desired by the majority of Town Council.
