EXPLANATION AND SUMMARY:
On March 10, 2025, the Town Council held a work session on the topic of location of swimming pools and hot tubs on residential lots. The purpose was to better understand the challenges presented by the current code, and the proposed code changes that would give property owners more options.
The Town Council provided input that resulted in minor, clarifying changes to the proposed code. Those changes are reflected in Attachment 1, which is the proposed amended code presented in redline and clean. The changes were sufficiently minor that the public hearing held on Jan. 27, 2025, was still relevant.
The purpose of this agenda item is for the Town Council to approve the proposed code amendments, including the minor changes from the work session, and then to direct the Town Clerk to advertise the Notice of Intent to Adopt. The proposed date of adoption is April 7, 2025.
Town Attorney Recommendation: The Planning Commission has submitted its recommendations to the Town Council on proposed edits/amendments to the Chapter 18, the Town Council has conducted a public hearing on the proposed amendments to Section 18-407 of the Town Code, and the Town Council may approve the proposed amendments in its discretion.
Town Manager's Recommendation: I recommend the Town Council approve the changes as drafted to Section 18-407 of the Town of Vienna Zoning and Subdivision Ordinance, as presented.

"I move to approve the changes as drafted to Section 18-407 of the Town of Vienna Zoning and Subdivision Ordinance, as reflected in Attachment 1, and direct the Town Clerk to Advertise a Notice of Intent to adopt said zoning changes on April 7, 2025, with an effective date 10 days after the publication of the Notice of Adoption."
