EXPLANATION AND SUMMARY:
On March 24, 2025, the Town Council approved the final language of the proposed amendments to Town Code Section 18-407, which, if adopted, would provide more flexibility in the placement of swimming pools and outdoor hot tubs to owners of certain lots zoned for single-unit detached residential homes. The proposed amendments are shown in Attachment 1, both clean (as they will appear in the code) and with redlines showing the changes and the existing language that is being replaced.
On March 24, the Town Council also directed the Town Clerk to advertise the Notice of Intent to Adopt the code amendments on April 7, 2025, which has been done.
The entire process for the code amendments to Section 18-407 started as part of a much larger packet of more than 50 code amendments. It involved the following steps, including both the Planning Commission and Town Council processes:
- March-May 2024: Town Council Work Sessions as follow-up to Code Create.
- October 7, 2024: Referral of a series of proposed code amendments to the Planning Commission.
- December 11, 2024: Planning Commission public hearing on all the proposed code amendments, and recommendation to the Town Council.
- January 27, 2025: Town Council public hearing on all the proposed amendments, and direction to Town Clerk to advertise the Notice of Intent to Adopt for the other items. Request by the Town Council to hold a work session on the topic of swimming pools and outdoor hot tubs for a work session.
- February 24, 2025: Town Council adoption of proposed code amendments except for those covering swimming pools and outdoor hot tubs.
- March 10, 2025: Town Council work session on swimming pools and outdoor hot tubs.
- Town Council March 24, 2025, approval of final language and direction to Town Clerk to advertise the Notice of Intent to Adopt the code amendments on April 7, 2025, proposed code changes that would give property owners more options.
Next Steps
If the Town Council votes to adopt the code amendments to Section 18-407, the Town Clerk will advertise the Notice of Adoption and the new code will become effective 10 days later, on April 17, 2025.
During the discussion on March 10, 2025, the Town Council indicated interest in potentially revising the regulations related to outdoor hot tubs, as it may make sense to provide even more flexibility as to their placement as compared to swimming pools. Staff will review options and bring back alternatives for the Town Council to consider, as part of a future package of potential changes to zoning regulations, later in 2025.
Departmental Recommendation:
The Department of Planning and Zoning recommends that the Town Council consider adopting the code amendments as presented in Attachment 1, to provide more flexibility for the placement of swimming pools and outdoor hot tubs, to owners of certain properties zoned for single-unit detached homes.
Town Attorney Recommendation: The Town Council has conducted a public hearing to receive public comments and received recommendations of the Planning Commission on the proposed amendments to Town Code Section 18-407. The Town Council may adopt the proposed amendments in its discretion.
Town Manager's Recommendation: I recommend the Town Council adopt the draft amendments to Chapter 18 of the Town Code, as presented.
