Request to set a Public Hearing for Sept. 28, 2026, for Green Hedges School’s request for Modification of Requirements

Green Hedges School has submitted an application for Modifications of Requirements pursuant to Section 18-830 of the Town Code in connection with proposed campus improvements at 415 Windover Ave., NW. The application includes requests for modifications related to lot coverage, frontage improvements, loading space requirements, parking lot landscaping, buffer dimensions, bicycle parking, and construction commencement timelines.
In accordance with Section 18-830 of the Town Code, the application was reviewed by Town staff and transmitted to the Planning Commission for recommendation. The Planning Commission reviewed the request over the course of three meetings held on Jan. 14 and 28, and Feb. 11, 2026, and voted 5-2 to recommend approval of the requested Modifications of Requirements with conditions.
The applicant has also submitted a related amendment to the existing Conditional Use Permit (CUP) for the school. The Board of Zoning Appeals reviewed the request over the course of two meetings held on May 20 and June 17, 2026, and voted 6-1 to approve the amendment with conditions.
The next step in the review process for the Modifications of Requirements application is for the Town Council to hold a public hearing and make a final determination on the request. Staff recommend setting the public hearing for Sept. 28, 2026.
DATE(S) OF PRIOR COUNCIL CONSIDERATION OF THIS ISSUE:
On the same day (Aug. 24, 2026), the Town Council will also hold discussion on this topic during a Work Session.
EXPLANATION AND SUMMARY:
Section 18-830.D of the Town Code requires Town Council review and determination of requests for Modifications of Requirements at a public hearing. The Planning Commission has completed its review and forwarded a recommendation to Town Council for consideration.
The requested Modifications of Requirements are related to a separate application to amend the school’s CUP, which is under the jurisdiction of the Board of Zoning Appeals (BZA). As indicated above, on June 17, 2026, the BZA voted 6-1 to approve the proposed amendment with conditions.
Departmental Recommendation: The staff recommends that the Town Council set a public hearing for Sept. 28, 2026, and direct the Town Clerk to advertise the Notice of Public Hearing in accordance with Town Code and applicable state law requirements.
Town Attorney Recommendation: The Planning Commission has reviewed the application for a site plan modification and the Town Council may set a public hearing to consider the request for Modifications of Requirements in its discretion.
Town Manager's Recommendation: I recommend the Town Council set a public hearing for September 28, 2026 for modification of requirements for the Green Hedges School, as presented.
