EXPLANATION AND SUMMARY

Request:

The Board of Supervisors of Fairfax County requests that the Town Council of the Town of Vienna grant certain land rights for a sanitary sewer easement in the Town of Vienna’s Northside Park property, identified by Tax Map Number 038-1-02-0023 and 038-1-02-0024, in exchange for the sum of $210,000.00 of total compensation.  Compensation includes $87,840.00 for the required land rights; and $122,160.00 for tree planting in the Town of Vienna.

Discussion:

Northside Park is a 21-acre parcel.  The proposed Sanitary Sewer Easements contain a permanent easement area of 15,515 square feet and a temporary construction and grading easement of 8,000 square feet on this parcel as shown in the attached offer package.  An appraisal, offer for compensation, and proposed Deed of Easement are available in the attachments. 

The purpose of the construction project is to increase the capacity of the Fairfax County Sewer system to accommodate anticipated growth in northern Fairfax County.  The duration of the proposed construction project is 3.5 years and the schedule and duration for the portion of the project that is routed through the Town of Vienna will be available after the Fairfax County construction contract is awarded. 

Approximately 87 trees must be removed from the proposed sanitary sewer easement.  Fairfax County is providing compensation that will enable the Town of Vienna to adequately address this impact by planting new trees at an estimated two for one replacement ratio in other locations to support tree canopy goals and initiatives.

Community Engagement:

Fairfax County hosted a public meeting to review the project and answer questions from the community on May 10, 2022.  A project website with updates and Fairfax County points of contact can be found at:

The Town of Vienna will also share Fairfax County construction status updates via Town media outlets once this information is available.

 

Background:

The Fairfax County Department of Public Works and Environmental Services, which is responsible for wastewater collection and treatment in Fairfax County, is working on several wastewater infrastructure projects to collect and treat the additional wastewater that is anticipated to come from the northern parts of Fairfax County. The Tysons Wastewater Conveyance Systems Modifications project is one of these projects.

The goal of Tysons Wastewater Conveyance Systems Modifications project is to increase the size of the sewer system to accommodate the planned growth in the northern Fairfax County and to ensure the system continues to provide continuous reliable service to all customers. This project will decrease the risk of wastewater overflows and back-ups during periods of high wastewater flows by diverting flow from existing infrastructure.

Next Steps:

If approved by Council, the deed of easement will be executed.

Expected Completion Time Frame:

The duration of the proposed construction project is 3.5 years and the schedule and duration for the portion of the project that is routed through the Town of Vienna will be available after the construction contract is awarded.

Town Attorney Recommendation: The Town may grant the proposed Easement to Fairfax County and accept the proposed compensation in its discretion.  Because the grant is to another political subdivision, no public hearing is required, pursuant to Virginia Code 15.2-1800.

Town Manager's Recommendation:  I recommend the Town Council grant certain land rights to Fairfax County for a sanitary sewer easement as a described in this report, in exchange for the sum enumerated in this report, as presented.

Cost and Financing: $210,000.00 in compensation
