EXPLANATION AND SUMMARY

On Oct. 23, 2023, as a conclusion to the project Code Create Vienna, the Town Council approved updated Zoning and Subdivision regulations, which were adopted as a new Chapter 18 of the Town Code. The new code became effective on Jan. 1, 2024, and can be found at www.viennava.gov/home/showpublisheddocument/4738/638379086972230000 <http://www.viennava.gov/home/showpublisheddocument/4738/638379086972230000>.

 

During the code update process, certain topics were identified as "pinned" items that, for various reasons, would need to be addressed after the updated Chapter 18 was adopted. The Town Council and staff also discussed that the zoning and subdivision ordinance is a dynamic document, subject to regular reviews and updates.

 

In January 2024, the Town Council set four priorities for calendar year 2024.  Among those priorities were follow-up amendments to the Zoning Ordinance. For that reason, staff met with the Town Council over several sessions from February through May 2024 to review the “pinned” items and receive guidance on them, including the priority of addressing the proposed edits.

 

Staff is bringing forward those items identified as simple corrections and “high priority” edits that did not require additional study. Staff has also identified additional items for Town Council consideration. These new items are relatively simple and reflect the staff’s use of the document for the past nine months.

Departmental Recommendation: Staff recommends that Town Council set a public hearing on proposed amendments to Chapter 18 and refer the proposals to the Planning Commission for consideration.

 

Town Attorney Recommendation:  The Town Council may refer proposed Zoning text amendments to the Planning Commission and set a public hearing to consider public input after receiving the Planning Commission’s recommendations in the Town Council’s discretion.

 

Town Manager's Recommendation:  I recommend the Town Council refer to the Planning Commission for consideration the proposed amendments to Chapter 18 Zoning Subdivision Ordinance, as presented and refer to the Planning Commission for consideration the proposed amendments to Chapter 18 Zoning Subdivision as amended and set a public hearing for December 9, 2024, as presented.
