Approve Changes to Planning and Zoning Fee Schedule, Chapter 1 Section 1-12 of the Town Code

EXPLANATION AND SUMMARY:
With the adoption of the changes to the Town Code for outdoor seating, the Planning and Zoning department wishes to update the schedule of Planning and Zoning Fees, Chapter 1, Section 1-12 of the Town Code to add a fee for an outdoor dining permit and for a temporary outdoor dining permit utilizing off-street parking. At the same time, several other minor wording and fee changes will be incorporated to the fee schedule.
The changes include new fees as follows:
- Amendment to proffered conditions of $5,000
- Add fee for master sign plan of $300
- Add fees for appeals to Town Council from BAR decisions of $250
- Add family day home permit of $100
- Remove fee for temporary signs; all signs have a $95 per sign fee
These changes, plus some wording changes are shown in the red-lined fee schedule attached.
Staff requests Council approve the fee schedule for adoption.

Town Attorney Recommendation: Zoning fees must be reasonably related to the staff and administrative costs associated with reviewing and processing the application. The Town Council may approve the proposed amended Planning and Zoning fees in its discretion.
Town Manager's Recommendation: I recommend the Town Council adopt the changes to Chapter 1, Section 1-12, Schedule of Planning and Zoning Fees, as presented.
