Adopt new chapter 18 (Zoning and Subdivision) of Town Code, and repeal current chapters 17 (Subdivisions) and 18 (Zoning) of the Town Code.

DATE(S) OF PRIOR COUNCIL CONSIDERATION OF THIS ISSUE:
Since the process of updating the Town’s zoning and subdivision code was initiated as a project (Code Create Vienna) on July 6, 2020, the Town Council has met almost 40 times, in either a regular meeting or a conference session, to discuss concepts, drafts, the process and to hear from the public. The Planning Commission has also met many times for the same purposes. In addition, there has been a very active community engagement component to Code Create, from the very beginning up to and including the public hearings on July 10 and 12, 2023, and the subsequent close of the written record. On Oct. 2, 2023, the Town Council voted to direct the Town Clerk and staff to advertise and conduct all required notifications of the Town Council’s Intent to Adopt the updated zoning and subdivision chapter.
EXPLANATION AND SUMMARY:
The purpose of this agenda item is for Mayor and Council to vote to adopt the ordinance that replaces the existing Chapters 17 (Subdivisions) and 18 (Zoning) of the Code of Vienna with a new Chapter 18, to include both Zoning and Subdivisions, which is provided as Attachment 1. Also part of the adoption is the updated zoning map (Attachment 2).
Per prior direction of the Town Council, and as reflected in Attachment 1, the effective date of this new Chapter 18 and zoning map will be January 1, 2024. Until that date, the existing Chapters 17 and 18 will remain in effect.
Staff from the Department of Planning and Zoning would like to take the unusual liberty in a staff report to thank the Town Council, Planning Commission, other boards and commissions, other staff throughout the Town of Vienna, ZoneCo and, most importantly, the broader community for this large effort and for reaching this milestone.

Departmental Recommendation: Based on the Town Council’s having provided direction, on Oct. 2, 2023, to advertise the Notice of the Town Council’s Intent to Adopt the updated Chapter 18 on Oct. 23, the Department of Planning and Zoning recommends that the Town Council vote to adopt the code update and zoning map as presented and direct the Town Clerk to advertise the Notice of Adoption with an effective date of Jan. 1, 2024.
Town Attorney Recommendation: The Town has conducted extensive public outreach on proposed updates and modifications to the Town’s subdivision and zoning ordinances contained in current Town Code Chapters 17 and 18. The Planning Commission and the Town Council have conducted public hearings on the proposed CodeCreate amendments and recodification to Chapters 17 and 18, and the Town Council may adopt the proposed replacement provisions to Chapter 17, 18, and the Zoning Map in its discretion.
Town Manager's Recommendation: I recommend the Town Council adopt the new Chapter 18 of the Town Code, as presented.
