EXPLANATION AND SUMMARY:
The Town Attorney has a contract with the Town and a supplemental budget for additional invoiced legal fees and litigation related costs. The Town Attorney's contract and rates have only seen minor adjustments in the past several years and have lagged behind market rates. This year's budget includes an 8.2% increase to partially address appropriate rate increases in the "Legal Services" portion of the Legal Services Contract, as discussed in Budget and past contract discussions between the Council, Town Manager, and the Town Attorney.
The purpose of this agenda item is to appropriate the Town Attorney's fees including the supplemental account for fiscal year spending. These amounts have already been approved in the Budget and the Town has an existing legal services contract.

Town Attorney Recommendation: As part of the regular Town Budget process the Town Attorney submitted a proposed Town Attorney legal services budget. As outlined in the Town Attorney Budget message, the Town Attorney and his law firm provide a broad variety of legal services under the legal services contract, including general counsel work, monitoring litigation, prosecution services in the General District Court, and other as needed legal services.
The Town Council has approved the Town Attorney's legal budget and legal services contract and may approve the proposed in its discretion so the Department of Finance may process legal purchase orders. The Supplemental Legal Services are invoiced as needed when legal additional legal services are provided under the Town's Legal Services Contract.
