Request award of IFB 20-11, Piney Branch Stream Restoration - Construction and request approval of Amended Funding Agreement with Fairfax County

EXPLANATION AND SUMMARY:
On December 19, 2019, six (6) bids were received for IFB 20-11, Piney Branch Stream Restoration. Of those six, Avon Corporation, of Alexandria, VA, was deemed the lowest responsive and responsible bidder with a total bid amount of $1,311,532.62. This project will be funded 50% from a DEQ Stormwater Local Assistance Fund (SLAF) and 50% match from Fairfax County Stormwater Tax. The contract amount is higher than the original estimate; however, once the contract is awarded, DEQ will finalize the grant agreement based on the contract award amount. The Fairfax County Funding Agreement signed by Town Council in October 2017 has also been amended to equal the 50% match based on the contract amount.
At this time, the Department of Public Works requests awarding IFB 20-11 to Avon Corporation in the amount of $1,377,110 (bid + 5% contingency) and approval of the Amended Agreement with Fairfax County.

Town Attorney Recommendation: The Town Council may award the contract for the proposed stream restoration project to the lowest responsive and responsible bidder in its discretion.
N.B.: A disqualified bidder has filed a bid protest and the Fairfax County Circuit Court will hear arguments from the parties on Motion for a Preliminary Injunction on February 19, 2020. The Town Attorney will provide an update after the Court rules on the motion.
