EXPLANATION AND SUMMARY: The Commonwealth of Virginia, as well as other states and localities, filed suit against opioid distributors and manufactures. As part of the litigation, localities could opt in or opt out of the proposed class action. The Town of Vienna elected to participate in the lawsuit and a "New Proposed National Opioids Settlement" has been proposed as it relates to a settlement with Kroger. The Virginia Attorney General has recommended the Town submit its Participation Form on or before the deadline of Aug. 12, 2024.
The Town Manager and Town Attorney recommend that the Town continue to participate in the class action settlement and adopt the proposed Resolution authorizing the execution of the Participation Form. This would enable the Town to participate in the settlement distribution made to the state and Fairfax County. The greater the local participation in the settlement the greater the amount of funds that will be available to Virginia.

Town Attorney Recommendation: The Town Attorney recommends approval of the proposed Resolution approving the Town's continued participation in the proposed class action settlement of opioid-related claims and execution of the proposed Participation Form.
