EXPLANATION AND SUMMARY: At the Oct. 16, 2023, Conference Session the Town Attorney presented suggested changes to the Town’s Noise Ordinance Sections 10-20.1., 10-44, and 3-11.  The Council expressed a desire to conduct a public hearing on the ordinance.

 

Departmental Recommendation:  Recommends setting a public hearing.

 

Finance Recommendation:  N/A

 

Purchasing Recommendation:  N/A

 

Town Attorney Recommendation:  The Town Council may set a public hearing to receive public comment on proposed changes to the Town’s noise ordinance provisions in its discretion. The Town Council is not statutorily required to hold a public hearing on proposed amendments to noise provisions of the Town Code except if part of the Zoning Ordinance.

 

Town Manager's Recommendation:  I recommend the Town Council set a public hearing for November 13, 2023 and possibly have a Conference Session on that same night so the Town Attorney will know what language to use for the ordinance that the Town Council will consider for adoption.
