EXPLANATION AND SUMMARY:
On January 5, 2015, the Town Council authorized and the Town Clerk formally advertised a Public Hearing for the vacation of a portion of Ninovan Road SE located east of Tapawingo Road and adjacent to 911 Ninovan Road SE.

Over the years, the Sahni family has assembled a number of parcels in the vicinity of Tapawingo Road SE and Ninovan Road SE. These parcels, located at 910, 911, 916 and 922 Ninovan Road SE, are being combined for the purpose of creating a 8-lot subdivision to be called Onondio Cove. The new lots would be accessed from an extension and reconfiguration of Ninovan Road SE, to include a cul-de-sac. In conjunction with the creation of this final plat, a portion of existing Ninovan Road SE-in front of the dwelling at 911-is being requested for vacation to allow it to be incorporated into the new subdivision.

Following Code of Virginia, Title 15.2, Article 2, Chapter 20, the Town Council approved the appointment of viewers to determine any future public use of the property. The viewers met on November 12, 2014 and found, in their opinion, that the vacation would not create any inconvenience to the general public. An independent appraisal was also be completed, at the applicant's expense. Prior to Council action, the applicant provided a Deed of Consolidation, survey plat, metes & bounds description and surveyor's report of how the land was deeded to the Town and for what purpose. The surveyor must give their professional opinion on who the property reverts to when vacated.

Because Ninovan Road SE is a public street currently providing access to homes, any vacation must be contingent upon the Onondio Cove subdivision being approved, demolition of the existing houses, and recording/relocating any public utility easements. The Planning Commission first con...
