Vienna License/Franchise Agreement with Level 3 Communications, LLC (a subsidiary of Lumen Technologies)

EXPLANATION AND SUMMARY: Level 3 Communications, LLC (“Level 3) has operated telecommunications network within the Town of Vienna and has its system installed in the right-of-way. Level 3 wishes to renew and extend its License/Franchise, and there are no substantive changes to the Agreement. The license fee is set by Virginia Code and the fees are collected at the state level and the distributed to the Town. There have been no operational issues between the Town and the licensee in the past.

Town Attorney Recommendation: The Town Attorney has worked with representatives of Level 3 to draft an acceptable update to the License/Franchise to use the Town right of way. If acceptable to the Town Council, it may be approved in the discretion of the Town Council.
Town Manager's Recommendation: I recommend the Town Council approve the proposed five (5) year License/Franchise Renewal Agreement between the Town and Level 3 Communications, LLC and authorize the Mayor, as presented.
