Intent to adopt the proposed amendments/modifications to Chapter 22 - Massage Salons, Health Clubs, etc.

EXPLANATION AND SUMMARY:
At a recent Conference Session Councilmember Brill raised the issue of the proliferation of massage establishments in the Town and the region and requested the Town Attorney to review and provide possible amendments to Chapter 22 to address the expansion of massage salons in Vienna and possible illegal activity at unlicensed businesses.
In preparation for the Town Council Conference Session, the Town Attorney reviewed the information provided by Councilmembers Brill and Anderson, the Virginia State Code, other jurisdictions' ordinances and the current Town Code. The Town Attorney also met with the Chief of Police and Finance staff to gather information on how the Town currently enforces its current ordinance. Based upon input received, the Town Attorney drafted proposed updates and amendments to the Town Code provisions relating to massage establishments, specifically Chapter 22 of the Town Code. The Town currently has its own permit/license regulations for massage salons, health clubs and other establishments that perform massages and that would remain under the proposed amendments; however, additional definitions, enforcement authority and penalties for non-conformance are proposed. Part of the regulatory process is a background investigation done by the Police Department for the operators of establishments performing massages as well as the employees performing massages.
At the June 13, 2022 Town Council conference session, the Town Council considered the proposed amendments to Chapter 22 and indicated that with some minor additions, the Town Council was ready to consider adopting amendments to Chapter 22 to update the current Code provisions and to provide additional inspection and enforcement provisions.
The Town Clerk has advertised a Notice of Intent to Adopt the proposes Amendments to Chapter 22.
