Public Hearing on the proposed Adoption of an Ordinance Authorizing the Collection of E-Summons Fees.

EXPLANATION AND SUMMARY: The proposed Ordinance authorizes the Town Court Clerk to collect an “e-summons fee” of up to five dollars ($5.00) as part of the costs for criminal and traffic cases heard in the Town’s General District Court. The General Assembly has authorized localities to collect this fee to assist with the funding and implementation of the electronic summons system to be used by law enforcement.
Departmental Recommendation: The Town Attorney recommends approval of the proposed ordinance.
Finance Recommendation: Recommend approval.

Town Attorney Recommendation: The Town of Vienna requested the General Assembly to permit towns to assess the e-summons fee since Fairfax County is already implementing the system and collecting the fee. The Town must use the fees collected only to fund and implementation an electronic summons system.
Town Manager's Recommendation: I recommend the Town Council approve to adopt the proposed e-summons fee ordinance, specifically amending Chapter 9, Motor Vehicles and Traffic, Article 1 as presented.
