Request Approval of a License Agreement between the Town of Vienna and NOVA Parks for the Community Center Renovation and Expansion Project related to the Washington and Old Dominion Trail Relocation and Improvements.

EXPLANATION AND SUMMARY:
As part of the Community Center renovation and expansion project the Washington and old Dominion (W&OD) Trail will be relocated to its original, pre-Community Center location. In addition the trail will be widened to include enhanced safety improvements. In doing so, a license agreement is required between the Town and NOVA Parks. NOVA Parks has already signed the agreement. The Town Attorney has reviewed the document as well.
Departmental Recommendation: Recommend approval and authorize Mayor to execute.

Town Attorney Recommendation: The Town has previously entered into license agreements related to the location of the Old Dominion Trail and the Town Council may approve the proposed License Agreement between the Town of Vienna and NOVA Parks for the Community Center Renovation and Expansion Project in the discretion of the Town Council.
Town Manager's Recommendation: I recommend the Town Council approve the license agreement between NOVA Parks and the Town for the W&OD Trail relocation and safety enhancements as part of the Community Center renovation as presented.
