Consideration of a Proposed Ordinance and request to Advertise an Intent to Adopt to Amend Chapter 2, Administration, of the Code of the Town of Vienna, Adding a New Article 7 and New Sections 2-69 to 2-71 to Establish Procedures for the Disposition and Disposal of Property Seized by the Police in Accordance with Virginia Code Section 15.2-1719 (1950 as amended).

EXPLANATION AND SUMMARY:
Departmental Recommendation: The Police Department seizes property and evidence during the regular course of investigations and also receives lost or found property. The Virginia Code permits localities to dispose of such property after advertisement in accordance with Va. Code §15.2-1719. Such property generally may be donated, sold or destroyed, depending on the type and value of the property. The Police Department will promulgate a general order, consistent with the Town’s Ordinance and the Va. Code detailing the specific procedures based on property type.

Town Attorney Recommendation: The Town Council may approve the proposed enabling ordinance language, direct the Town Clerk to advertise an intent to adopt and set a date for adoption at a public meeting in its discretion.
