Request to Set The Date to Amend The Fiscal Year 2016 Operating Budget, Public Hearing for February 22, 2016.

EXPLANATION AND SUMMARY:
According to Virginia State Code 15.2-2507, “any locality may amend its budget to adjust the aggregate amount to be appropriated during the fiscal year. However, any such amendment which exceeds one percent of the total expenditures shown in the currently adopted budget must be accomplished by publishing a notice of a meeting and a public hearing once in a newspaper having general circulation in that locality at least seven days prior to the meeting date. The notice shall state the governing body’s intent to amend the budget and include a brief synopsis of the proposed budget amendment. Any local governing body may adopt such amendment at the advertised meeting, after first providing a public hearing during such meeting on the proposed budget amendments.” Once adopted, those funds can then be appropriated.
Ordinary budget amendments during the year are donations received by the Town, and expenditures are increased to accommodate the donation amount. These amounts are nominal and do not exceed one percent of total expenditures. This year, Community Center renovation and construction capital expenditures are exceeding the budget by an amount not expected to exceed $900,000, which requires a public hearing for the amendment.
The public hearing is requested to afford Vienna residents an opportunity for public comment.
Departmental Recommendation: In order to accommodate additional costs for the Community Center renovation and construction project, additional funding is required. This funding requirement exceeds one percent of the adopted budget. A public hearing is required for this budget amendment. A detailed outline of the costs associated with this amount is attached.

Town Attorney Recommendation: Pursuant to Virginia State Code §15.2-2507, if a proposed budget amendment exceeds 1% of the adopted fiscal year budget, Town Council must advertise and conduct a public hearing on its intent to amend the budget. Town Council may set a public hearing date and direct the Town Clerk to advertise the public hearing at its discretion.
Town Manager's Recommendation: I recommend the Town Council set a public hearing for February 22, 2016 on an amendment of the Fiscal Year 2016 Operating Budget in an amount not to exceed $900,000, for the completion of the Community Center Renovation project as presenter, in the amount presented.
