EXPLANATION AND SUMMARY:

The proposed Modification and Addendum covers the delay claims associated with approved project change orders. The proposed Modification and Addendum will set a new "substantial completion date" as well as approve general condition payments to the Contractor that would be due under the contract for certain delays in the project. Under the terms of the proposed Addendum, the new Project Substantial Completion date would be August 11, 2017.

The Town Manager, the Town's Scheduling Consultant, the Town Attorney, and staff have participated with the Contractor in the review, analysis and discussion of the proposed contract modification and general condition payments associated with project delays and reached a proposed net amount of additional days and compensable general condition payments to the Contractor. Any delays associated with the Contractor and/or not compensable under the terms and conditions of the IFB have been accounted for and credited.

This amount is covered in the contingency already approved by Council in July, 2016.

Departmental Recommendation: Recommend approval.

Finance Recommendation: Recommend approval.

Town Attorney Recommendation: The Town Attorney, with the assistance of the Town's outside scheduling consultant, recommends the approval of the proposed Modification and Addendum to Contract IFB 1604.

Town Manager's Recommendation: I recommend the Town Council approve the proposed Modification and Addendum as presented.
