EXPLANATION AND SUMMARY

The relationships among zoning code articles and sections were considered during a June 12, 2017 Council work program prioritization work session. The Department of Planning and Zoning has attached recommended changes to the highest-ranking item: C-1/restaurant provisions.

 

Departmental Recommendation:  Staff recommends forwarding proposed changes on the C-1/restaurant code - Chapter 18: Zoning Article 11: C-1 Local Commercial Zone Regulations, Section 72: Permitted Uses - to the Planning Commission. The proposed change removes the requirement that a restaurant may be located in a shopping center or freestanding only if it provides seating for a minimum of 125 patrons.

Town Attorney Recommendation:  In its discretion, Town Council may refer proposed amendments to the Town’s zoning ordinance to the Planning Commission for review and recommendations.
