Terminate Maple Avenue Design Guidelines Contract with Lardner/Klein Landscape Architects

EXPLANATION AND SUMMARY:
On June 5, 2017, Council awarded a contract to Lardner/Klein Landscape Architects for $48,176 to develop design guidelines for Maple Avenue Commercial (MAC) Zone projects. Work commenced on the project last summer. The first invoice for work through September 30, 2017, for $7,231.80, was submitted October 3, 2017. It was paid by the Town on October 17, 2017.
At direction of the Town Manager, work on the project was halted in October following issuance of a consultant questionnaire to Board of Architectural Review (BAR) members, which they perceived to be outside the intended purpose of the project as well as especially critical of the BAR. A second invoice for $2,500 was submitted November 9, 2017 for "missed billing in Invoice #1." The second invoice has not been paid.
The new Director of Planning and Zoning (DPZ) feels the intent of the project to provide visual guidance to MAC projects could best be achieved by DPZ staff and that the contracted work is unnecessary.
Departmental Recommendation: Recommend contract termination.
Finance Recommendation: Agree with DPZ recommendation. This is a 2017 carry-forward request to FY2018. The remainder could be used for other DPZ projects.
Purchasing Recommendation: Recommend approval.
Town Attorney Recommendation: After notice to the contractor, Town Council may authorize termination of this architectural services contract for the convenience of the Town in the discretion of Town Council.
Town Manager's Recommendation: I recommend the Town Council terminate for convenience the design guidelines contract with Lardner/Klein Landscapes Architects and further move to thank Lardner/Klein for its services to the Town as presented.
