EXPLANATION AND SUMMARY:
The General Assembly has raised threshold property value limits for petit larceny from $200 to $500. An amendment to the Town Code related to criminal charges of petit larceny and concealment (shoplifting) is needed.
Departmental Recommendation: Recommend approval.
Finance Recommendation: N/A
Purchasing Recommendation: N/A
Town Attorney Recommendation: State larceny thresholds are mandatory, and the Town currently uses the state code for larceny offenses. This amendment will enable magistrates to issue a warrant or summons under the Town Code. The only administrative difference to the Town will be allocation of the collected court costs in the event of a conviction. The Town Attorney recommends adoption of the proposed amendments.
Town Manager's Recommendation: I recommend Town Council approve the proposed amendment to Chapter 10 of the Town Code related to threshold value limits for misdemeanor larceny offenses, and that the Town Clerk be directed to advertise a Notice of Intent to Adopt.
