Request vacation of abandoned sanitary sewer easement on 102 Sharon Lane NW

EXPLANATION AND SUMMARY:

 

Recent development and title/deed research on 102 Sharon Lane NW revealed the existence of a sanitary sewer easement for long-ago abandoned sewer service for an adjacent property.  The easement was created originally in 1959 with the Blaeuer subdivision (deed attached) and subsequently proposed to be vacated with the Bradmoor subdivision in 1962 (deed attached).  The easement on the Bradmoor plat is labeled as “to be vacated.”  There is no recorded evidence that a deed of vacation was ever filed for this easement.  The owners of 102 Sharon Lane NW would like to formally vacate the portion of the easement located on their property.  Attached are the proposed deed and plat for vacation.

 

Public Works staff has confirmed that the easement and associated sewer is abandoned and recommends the vacation of easement as historically intended.

 

Departmental Recommendation:  Recommend approval of easement vacation.

 

Finance Recommendation:  N/A

 

Town Attorney Recommendation:  As the original subdivision with new and vacated easements was formally adopted and recorded, Town Council may approve the proposed deed of vacation and authorize the Mayor to execute the deed, in the discretion of Town Council.

 

Town Manager's Recommendation:  I recommend the Town Council approve of the vacation of the sanitary sewer easement at 102 Sharon Lane NW and authorize the Mayor to execute the deed of vacation, as presented.
