Public Hearing on Proposed Amendments to Town Code Chapter 1, Section 1-9.1, Fee Charged for Passing Bad Checks to Town

EXPLANATION AND SUMMARY:
The Finance Department recommends changing Town Code, Chapter 1, Section 1-9.1 - Fee Charged for Passing Bad Checks to Town to reflect the amount allowed under the Code of Virginia, Section 15.2-106 - Ordinances providing fee for passing bad checks to localities. The current Town Code allows a fee of $20, while State Code allows for a fee not to exceed $50.
The Town intends to charge $25 for all returned checks or drafts, which will cover bank fees. This is a $5 increase from the fee previously charged. Changing the Town ordinance to match the State Code limit allows the Town the flexibility to raise the fee in the future, if deemed necessary.
Attached are red-lined and corrected ordinances, the State Code ordinance, and a survey of surrounding jurisdictions.
As this is a change to Town Code that affects taxes, a public hearing is required to allow for public comment.
Departmental Recommendation: This public hearing will allow Town of Vienna residents to comment on the proposed change to Town Code Chapter 1, Section 1-9.1, Fee Charged for Passing Bad Checks to Town.
