Emergency Town Council meeting to adopt Continuity of Government Ordinance

EXPLANATION AND SUMMARY: 

 

In consideration of the declared national emergency by the President of the United States, the declaration of emergency by Virginia Governor Ralph Northam as well as the Fairfax County declaration and letter opinion of the Attorney General related to emergency authority of localities, the Town Attorney recommends immediate adoption of the proposed Continuity of Government Ordinance and also advertisement of the ordinance for re-adoption at Town Council’s next regularly scheduled meeting.  The proposed ordinance, authorized by Virginia Code Section 15.2-1413, will permit the Town to modify meeting and public participation methods to comply with the governor’s executive order and recommendations on limiting public gatherings and practicing social distancing. The Town will develop meeting procedures related to electronic participation by public bodies, public participation (i.e., submission of public comment through written and electronic methods), and logistical meeting planning to ensure safe social distancing.

Town Attorney Recommendation:  The Town Attorney recommends immediate adoption of the proposed Continuity of Government Ordinance and direction to the Town Clerk to advertise an intent to re-adopt the ordinance at the next Town Council meeting. 

 

Town Manager's Recommendation:  I recommend the Town Council adopt the proposed Continuity of Government Ordinance as drafted by the Town Attorney.
