Increase Appropriation for Supplemental Legal Services

EXPLANATION AND SUMMARY:
The Town Attorney’s 2019-2020 budget for supplemental legal fees is $50,000. Due to the impact of the coronavirus, the Town Attorney’s supplemental fees are estimated to exceed the budget by approximately $40,000. This will not have a negative impact on the general fund because approximately $40,000 of total supplemental legal fees is eligible for CARES funding.

Departmental Recommendation: Recommend approval to increase the budget for supplemental legal fees by $40,000, financed through the CARES Act.
Finance Recommendation: Recommend approval.
Purchasing Recommendation: Recommend approval.
Town Attorney Recommendation: The Town’s expenditure of budgeted funds is typically expected to be within or very close to budgeted amounts for supplemental legal services; however, due to the COVID-19 pandemic, additional supplemental legal expenses were incurred in FY19-20 and they will be paid through CARES Act funds. In addition to emergency legal matters, the Town Attorney has had to assign additional prosecutors to the Town of Vienna’s General District Court docket to address court-required COVID-19 procedures. Accordingly, Town Council’s approval for expenditure of funds is required.
Town Manager's Recommendation: I recommend the Town Council increase the appropriation for fiscal year 2020 supplemental legal fees to Briglia Hundley, as presented.
