EXPLANATION AND SUMMARY:
The Town has sought authority from the General Assembly to require developers to dedicate land and construct sidewalks in cases of single-lot redevelopment. Over the years, the General Assembly has granted more local authority, and recently the General Assembly amended the State Code to permit localities to adopt local provisions that would require construction of sidewalks in any redevelopment of property. Previously, single-lot redevelopment required construction of a sidewalk only if there was an existing sidewalk on an adjacent property.

Town Attorney Recommendation: The proposed ordinance amendment is based on the Virginia General Assembly’s expansion of local authority pursuant to Virginia Code Section 15.2-2242 to require a developer of a lot within an existing subdivision to dedicate land and construct a sidewalk on the property being developed. Previously, the Town had authority to require sidewalk constructed only if there was an existing sidewalk on either side of the property being developed.
