Public hearing to amend FY 2020-21 budget for use of CARES Act funding and supplemental appropriations

EXPLANATION AND SUMMARY:
On March 27, 2020 Congress passed the Coronavirus Aid, Relief, and Economic Securities Act (CARES Act) to provide support directly to state, local, and tribal governments to address the COVID-19 pandemic. Governments with populations greater than 500,000 could apply for direct federal payment from the CARES Act. Fairfax County was the only jurisdiction in the Commonwealth, aside from the Commonwealth itself, to receive direct funding (a “prime recipient” of funding). The county passed a proportionate amount of direct funding to the Town. The Town's portion was $2.886 million based on its July 1, 2018 US Census population; funds from Fairfax County were transferred to the Town of Vienna on April 29, 2020.
The Town will roll forward into its FY 2020-21 budget $1,820,692 of CARES Act funds not spent by June 30, 2020 but required to be spent by December 30, 2020. The Town also has supplemental appropriations for fiscal year 2020-21 from carry-forward budget amounts of $300,000 not spent by June 30, 2020 for the economic market study and zoning code rewrite. Additionally, the Town has rolled forward $172,860 in purchase orders for items in process, but not completed by June 20, 2020. The total budget amendment stands at $2,293,552 and is greater than 1% of the fiscal year 2020-21 budget, and therefore, pursuant to the code of Virginia, section 15.2-2507, a public hearing is required.
Accordingly, a public hearing is being held to invite public comment.

Town Attorney Recommendation: Under Virginia Code §15.2-2507, if a budget amendment is in excess of 1% of the previously adopted budget, a public hearing is required.
Town Manager's Recommendation: I recommend the Town Council close the public hearing and approve the $2,293,552 amendment to the FY 2020-21 general fund budget, as presented.
