Board of Zoning Appeals Work Session on Family Day Homes

BACKGROUND SUMMARY:
The Town of Vienna’s Zoning Ordinance is silent on regulations for family day homes. In June 2013, the Zoning Administrator made a determination with regards to family day homes in accordance with State and Fairfax County regulations at the time. The Zoning Administrator’s determination found that a family day home serving up to twelve (12) children did not meet the home occupancy provision as established by §18-173-Home occupation of the Vienna Town Code and a conditional use permit is required, in accord with the provisions of §18-31 and by reference §18-13.
OVERVIEW:
The Board of Zoning Appeals recommends that the Town Council amend the Town’s zoning ordinance to specifically grant the BZA the authority to grant conditional use permits for child day care activities that are not part of nursery or kindergarten school programs.

As part of the zoning update, the Consultant will be reviewing State Code regulations and previous zoning determinations to identify what provisions need to be codified, including regulations pertaining to family day homes.
