Resolution to Approve the Town's participation in the proposed National Opioid Settlement Agreements

EXPLANATION AND SUMMARY: The state of Virginia has elected to participate in two National Opioid Settlement Agreements which resolves all opioid litigation brought by states against the three largest pharmaceutical distributors. The settlement requires the pharmaceutical distributors to pay billions of dollars to abate the opioid epidemic.

After years of negotiations, two proposed nationwide settlement agreements have been reached that would resolve all opioid litigation brought by states and local political subdivisions against the three largest pharmaceutical distributors, McKessen, Cardinal Health, AmerisourceBergen, and one manufacturer, Janssen Pharmaceuticals, Inc. and its parent company Johnson & Johnson.

The State of Virginia has elected to participate in both national settlements and cities, counties, and towns (with population greater than 10,000) may participate in the settlement as long as they do so by Jan. 2, 2022.

It is important that every locality that can participate, does participate. The extent of participation will determine how much money each state and its localities receive because approximately half of the abatement funds are in the form of incentive payments where the higher participation of localities in a state, the greater the amount of settlement funds flow into that state.

To participate in the settlement (through Fairfax County), the Town of Vienna needs to approve a resolution. The Town Attorney has prepared the resolution in accordance with guidance from the Virginia Attorney General's Office.
