EXPLANATION AND SUMMARY:

The Vienna Public Art Commission (VPAC) presented to Town Council at the November 14, 2016 Council work session a recommendation for its inaugural project: a "Taking Flight" bronze statue to be dedicated to Mayor M. Jane Seeman and honoring Town of Vienna volunteers.

VPAC requests approval to make a 10% deposit payment made payable to Seth & Missy Vandable, the artists, for $3,900 in order to lock on a price for the art piece. The Vienna Public Art Commission has existing funds of $16,000, $10,000 of which is currently on-hand and $6,000 of which has been pledged. A fundraising campaign will begin January 1, 2017 to raise the remaining $31,000 needed to cover the cost of the sculpture.

Total budget for the Inaugural Project: $47,000
* Sculpture Cost: $39,000
* Base Cost: $8,000 (estimated, work to be performed by the Town)

The proposed sculpture payment schedule and tentative target dates are as follows:
* 10% deposit payment upon order: $3,900 (December 2016)
* 1/2 due upon pouring of the wax at foundry: $17,550 (March 2017)
* 1/2 due when ready for delivery: $17,550 (June 2017)

Departmental Recommendation: Recommend conditional approval.

Finance Recommendation: Recommend approval to pay deposit. Recommend approval of the remainder pending contract and funding approval by Town Council.

Purchasing Recommendation: N/A

Town Attorney Recommendation: While the contract and waiver procedures have not been submitted for review and will require some modification, the Town could negotiate a deposit for the proposed public art and direct staff to negotiate a final contract for review and approval at the next regular Town Council meeting.
